1. Introduction and Purpose

Aziz Art LLC respects the intellectual property rights of others and is committed to operating a marketplace that prohibits the use, display, or sale of any material that infringes on the copyrights of third parties. This policy outlines our stance on copyright infringement and the procedures for reporting and responding to claims of infringement on the Aziz Art LLC platform.

2. User Acknowledgment and Responsibility

A. Artist/Seller Responsibility:

By listing any artwork, image, text, or content on the Aziz Art LLC marketplace, the Artist/Seller represents and warrants that:

• They are the original creator and owner of all intellectual property rights (including copyright) in the work being sold and all associated listing materials (photos, descriptions, etc.).

• The work and all associated materials do not infringe upon any copyright, trademark, moral rights, or other proprietary rights of any third party.

• The Artist/Seller has secured all necessary licenses, permissions, or clearances for any third-party material included in their work or listing.

B. Buyer/General User Responsibility:

All users acknowledge that the artworks and content displayed on Aziz Art LLC are protected by copyright. Users may not download, reproduce, distribute, modify, publicly display, or create derivative works from the art or content on the site without the express written permission of the respective copyright owner (typically the Artist) or as otherwise permitted by law (e.g., Fair Use).

3. Copyright Ownership on Aziz Art LLC

• Artist Retains Copyright: Aziz Art LLC does not claim ownership rights to the content, art, or other intellectual property uploaded by the Artists/Sellers. The Artist retains all copyright to their original artwork, even after a print or the physical piece is sold, unless the Artist explicitly transfers the copyright in a separate written agreement with the Buyer.

• Limited License to Aziz Art LLC: By uploading content, the Artist grants Aziz Art LLC a limited, non-exclusive, royalty-free, worldwide license to use, display, and reproduce the content (e.g., images of the artwork) for the sole purpose of operating, marketing, and promoting the Aziz Art LLC website and the Artist’s work.

Aziz Art LLC operates in compliance with the DMCA and will respond to notices of alleged infringement that comply with the DMCA and other applicable laws.

A. Notification of Alleged Infringement (Takedown Notice)

If you are a copyright owner or an agent authorized to act on behalf of one, and you believe that content on Aziz Art LLC infringes upon your copyright, please submit a written notification (a “Takedown Notice”) containing the following essential elements:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.

3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Aziz Art LLC to locate the material (e.g., the specific URL/link to the artwork).

4. Information reasonably sufficient to permit Aziz Art LLC to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.

5. A statement that the complaining party has a good faith belief that use of the material in the manner complain²ed of is not authorized by the copyright owner, its agent, or the law.

6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

C. Our Response to a Takedown Notice

Upon receiving a valid Takedown Notice, Aziz Art LLC will:

• Promptly remove or disable access to the allegedly infringing material.

• Notify the Seller/Artist who posted the material that the material has been removed or access disabled.

• Provide the Seller/Artist with a copy of the Takedown Notice.

D. Counter-Notification (Appeal)

If an Artist/Seller believes that the material was removed or disabled by mistake or misidentification, they may submit a Counter-Notification to the Designated Copyright Agent containing the following elements:

1. A physical or electronic signature of the Seller/Artist.

2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

3. A statement under penalty of perjury that the Seller/Artist has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.

4. The Seller/Artist’s name, address, and telephone number, and a statement that the Seller/Artist consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the Seller/Artist’s address is outside of the United States, for any judicial district in which Aziz Art LLC may be found, and that the Seller/Artist will accept service of process from the person who provided the original Takedown Notice.

If a Counter-Notification is received, Aziz Art LLC may forward it to the original complaining party. If the complaining party does not inform us within 10-14 business days that they have filed a court action seeking a court order to restrain the Seller/Artist from engaging in infringing activity, we may restore the material to the site.

5. Repeat Infringer Policy

Aziz Art LLC maintains a strict policy of terminating access to the marketplace for any user who is determined to be a repeat infringer. This includes Sellers/Artists who have been subject to multiple valid Takedown Notices or other infringement allegations.
